SeaStay Vacation Rentals LLC
Thanks for your business and we hope you enjoy your stay in our property!

This agreement made 10/13/2024 between:

{reservations.first_name} {reservations.last_name} (hereinafter called the GUEST) and {propertymanagementinformation.company_name} (hereinafter called the MANAGER) concerning the short term rental of "{location_units.full_property_name}" (hereinafter called the PROPERTY or HOME).

Total people in renting party: {reservations.occupants} not to exceed {reservations.unit_max_occupants}. 
Rental period begins at {reservations.check_in_time} pm on {reservations.startdate} and ends at {reservations.check_out_time} on {reservations.enddate}.

****PAYMENT: Half of the total for your rental is due at the time of booking your reservation and includes all fees and taxes. The balance due must be received 30 days prior to your arrival. ****

Terms of the Agreement:
1. MANAGER agrees to rent the unit listed above for dates stated. (Advance reservations are accepted up to one year in advance however they serve only as the "first right of refusal" till OWNER  has confirmed their contract and owner block dates.)
 
2. GUEST must be 25 years of age or older.  We do not rent to groups of teenagers, with or without adult chaperones, or to college students under the age of 25.
 
3. GUEST must obey all community restrictions and occupancy limits. GUEST may not exceed the number of adults/children stated in the Property listing. Eviction WILL occur in the event of over occupancy, excessive noise, unseemly conduct, damage to property, etc. without refund of rental. MANAGER of PROPERTY is local and will enforce all restrictions.
 
4. GUEST shall keep the premise in good condition and free of trash.
 
5. MANAGER  and Home OWNERS shall be held harmless from all damages or injuries.
 
6. GUEST must use a calling card for all long distance phone calls and may not purchase pay-per-view TV services.
 
7. GUEST must purchase a $75 Limited Damage Protection Insurance Policy with all reservations. This insurance protects you for any damages which might occur during your rental period, up to $1500.
 
8. PETS: Pets are not allowed for this unit unless stated in the listing. Bringing a pet to a property where a pet is not allowed will result in a $500 charge to the credit card on file. If pets are allowed for the property, terms of the bringing a pet are called out in the Pet Addendum. 
 
9. SMOKING: NO SMOKING WILL BE ALLOWED IN ANY OF THE PROPERTIES. A breach will result in a $500 charge to the credit card on file.
 
10. ACCESS TO THE PROPERTY: Each unit has an electronic keypad. The access code is provided in the Reservation Booked Confirmation EMAILED TO YOU AFTER ALL PAYMENTS ARE RECEIVED.
Keypad access codes are changed after rental.
 
11. Trash must be removed from the unit at time of departure. Failure to do so will result in a $10 per bag charge to the credit card on file. Directions and location of outside bins are in the unit.
 
12. MAINTENANCE AND REPAIRS: Our homes are well maintained, but please understand that just like your own home, unexpected breakdowns and malfunctions do occur. We do not issue refunds for any maintenance problems or cleaning issues; however, we will make every effort to remedy these situations and correct any problems in a timely manner. We have maintenance personnel available, so please report any inoperative equipment or problems to our office immediately. For non-emergency situations, please leave a detailed message and someone will call you as soon as possible. Emergency maintenance, please call the after-hours number (850) 777-3096. Our professional staff will help remedy these situations in a timely manner; however, refunds will not be issued due to malfunctioning equipment, mechanical failures, unfavorable weather, early departure, interruption of utilities, construction in the area or other GUEST dissatisfaction. If a service call is deemed unnecessary, or a maintenance repair is needed as a result of tenant actions, the cost will be charged to your account, deducted from your security deposit or filed on your property damage insurance. MANAGER retains the right to enter the property for maintenance, repairs, or care of the property during reasonable hours. We will make every effort possible not to disrupt your stay. We occasionally experience outages beyond our control. No refund will be given for any power, internet, water or cable outages.
 
13. MANAGER: We represent the property owners, but we will diligently work toward making your stay enjoyable and memorable.
 
14. All monies received will be placed in a non-interest bearing account.
 
15. CANCELLATION: In the event that you must cancel, change dates or switch properties, please note that refunds will be handled as follows:
30 days - If the reservation is 30 days or more away, GUESTs can cancel without penalty. The full 100% of your payment will be refunded. Cancellation must occur by 11:59AM in the time zone the property resides.
14 days - If the reservation is within 14-29 days, a refund of 50% of the total rental amount. Cancellation must occur by 11:59AM in the time zone the property resides.
Cancellations inside of 14 days are not eligible for a refund.
When reservation is confirmed, any cancellation, date or property change will be subject to this policy, no exceptions. Travel Protection Insurance is available for purchase. GUEST with the Travel Protection Insurance will be directed to contact their insurer for changes and cancellations.
 
Travel Protection Insurance: We strongly recommend purchasing Travel Protection to protect your vacation investment. IF YOU CHOOSE NOT TO PURCHASE TRAVEL PROTECTION YOUR PAYMENT WILL NOT BE REFUNDED IN THE EVENT  THAT YOU CANNOT COMPLETE YOUR VACATION PLANS OR IN THE EVENT OF EVACUATION.
 
16. ERRORS OR IF A HOME BECOMES UNAVAILABLE: Every precaution is taken to ensure the availability of the unit you have selected. If the unit becomes unavailable, Agent reserves the right to transfer to comparable accommodations. Descriptions, rates, and property amenities listed in the brochure, website, or rental agreement are subject to change without notice. Omissions, additions, or errors as well as changes in bedding, furnishings, equipment, etc. may occur. No refund or adjustment shall be offered for such.
 
17. GUEST MAY NOT use ANY LOCKED property owner's CLOSETS UNDER ANY CIRCUMSTANCES. If damages occur, GUEST will be held liable.
 
18. Failure to depart at 10:00AM Eastern Standard Time will result in a double cleaning charge and possible other charges. Property must be cleaned and inspected after each rental. Checkout is a busy time and cleaners must stay on schedule. Upon checkout, we ask our GUEST to leave the property in the general condition upon arrivals. Departure responsibilities include removing food products from pantry, cabinet, fridge and freezer. We also ask that you start dishwasher, if necessary, and take out trash to exterior containers. Lock all doors and windows along with returning keys to lockbox, if applicable. Failure to comply may result in additional charges.  We will launder linens and complete house cleaning duties.
 
19. Where allowed, some homes are furnished with a gas grill. Propane tanks for gas grills are filled at the beginning of the season; however, if they are empty, we are not responsible for refill. You may refill them and present a copy of the receipt upon departure for reimbursement. Please, no charcoal in gas grills. The incoming GUESTs appreciate the courtesy of a clean grill. Grills left dirty will result in a $20.00 charge.
 
20. PARKING: No campers, RV’s, etc. are allowed on the premises. Parking of boat trailers is not permitted on the property unless specified (see Property Benefits on the listing). We recommend parking of boat trailers at the marina where the boat is launched, unless the property has boat parking available (see Property Benefits on the listing). Tenants may not park on the lawn.
 
21. You authorize MANAGERS to contact you at any of the phone numbers that you have supplied us with during normal business hours.
 
22. Linens are provided and the cost is included in the linen fee. One bath set per registered GUEST, one set of sheets per bed, along with scrub sponges and dish towels. A bath set includes one towel and one washcloth. One hand towel is provided per bathroom.
 
23. All linens and towels that are provided by Owner shall remain at the property at all times. GUEST agrees that GUEST shall not take linens from the PROPERTY to the beach. No indoor furniture shall be moved outside or taken to the beach under any circumstances. Any beach chairs, umbrellas or other items designed for outdoor use must be returned to the property each evening.
 
24. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL SEASTAY VACATION RENTAL, NOR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR DEATH, PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF SEASTAY VACATION RENTALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE   LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

25. Indemnity. You agree to hold harmless and indemnify SeaStay Vacation Rentals and Owner for all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during your stay.

26. Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, SeaStay Vacation Rentals reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit-Specific Terms specific to the substituted property, shall apply to your stay in the substituted property.

DEFINITIONS: GUEST-all registered GUESTs (within occupancy of unit stated) booked to share the same unit, who have elected to purchase the Damage Protection Insurance or pay the Security Deposit, and have paid the required cost of such.



(We) agree to abide by the above conditions and hereby swear that the information provided above is true. By electronically signing this agreement, you are also agreeing to the terms of the GUEST RENTAL AGREEMENT and the PET ADDENDUM listed below, if the property is pet friendly and you are bringing a pet.

Pet Addendum (Only applicable for properties where pets are allowed:


Guest hereby agrees to comply the following:
1. Guest to pay additional pet fee in the amount of $150, plus applicable taxes, per pet per stay.
2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request):
Only dogs are permitted in this property.
May not exceed 30 lbs without prior approval, unless stated in the listing or policies of the home. 
Must be at least 1 year(s) of age or older.
Must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive is highly recommended.
3. All pets must be leashed at all times.
4. Guest is responsible for cleaning up any/all pet refuse.
5. Pets are not allowed on furniture at any time.  Any evidence of pets on furniture may incur extra cleaning fees.
6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival.  Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets.
7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be deducted from security deposit.
8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors.
9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on balcony, patio, or porch.
10. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises.

The Guest shall be solely responsible for the pet while on the property.
